Terms of Service

Last reviewed: 5 August 2026. This policy will be finalised with legal counsel before public launch, but the substance below reflects the terms governing use of Avarius today.

1. Who we are

Avarius ("Avarius", "we", "us") is operated by Vovo Capital (Pty) Ltd, a company registered in South Africa under registration number 2024/073102/07, with its registered address at Old Pretoria Road, Midrand, South Africa, trading as Avarius at avarius.store — an online marketplace that connects South African shoppers with independent South African brands. By creating an account, browsing, or purchasing on Avarius, you agree to these Terms of Service.

2. Avarius is a marketplace facilitator, not the seller

Avarius provides the technology platform that lets brands list products and lets buyers purchase them. Avarius is not the seller of record for any product listed on the marketplace. Each brand is an independent business responsible for its own product descriptions, pricing, quality, stock, packaging, fulfilment, and legal compliance (including consumer protection, food safety, and any other applicable regulatory requirements for its products).

3. Brand responsibilities

Brands listed on Avarius must be approved through our seller application and review process. Approved brands agree to accurately represent their products, fulfil orders in a timely manner, communicate professionally with buyers, and comply with the Avarius Seller Agreement and all applicable South African law.

4. Buyer conduct

When using Avarius, you agree to provide accurate account and delivery information, use the platform only for lawful purposes, and treat brands and their staff with respect. Avarius reserves the right to suspend or terminate accounts that engage in fraud, abuse, harassment, or attempts to circumvent the platform (such as arranging off-platform payment to avoid marketplace protections).

5. Payments

Payments made through Avarius are processed by PCI-compliant third-party payment processors. Avarius does not store your full card details. Funds are held securely and released to brands in line with our order and payout terms, as described in the Seller Agreement.

6. Limitation of liability

To the maximum extent permitted by South African law, Avarius is not liable for any indirect, incidental, or consequential loss arising from your use of the marketplace, including losses relating to a brand's products, fulfilment, or conduct. This does not limit any right or remedy you have under the Consumer Protection Act that cannot lawfully be excluded.

7. Changes to these terms

We may update these Terms of Service from time to time as Avarius grows. Material changes will be communicated via the platform or by email. Continued use of Avarius after changes take effect constitutes acceptance of the updated terms.

8. Governing law

These Terms of Service are governed by the laws of the Republic of South Africa, and any disputes will be subject to the jurisdiction of the South African courts.
