Brand / Seller Agreement

Last reviewed: 5 August 2026. This agreement will be finalised with legal counsel before public launch, but the substance below reflects the terms approved brands operate under today.

1. Becoming a seller

This agreement applies to any brand approved to sell on Avarius following our seller application and review process. By listing products on Avarius, you agree to the terms below in addition to our general Terms of Service.

2. Commission structure

Avarius charges a commission of between 8% and 15% per sale, depending on product category, deducted automatically from your payout before funds are released to you. Your specific commission rate is confirmed during onboarding and shown in your seller portal.

3. Listing fees

Listing on Avarius is free for your first 90 days from approval. After this period, a monthly tier fee applies based on your listing volume and plan, communicated in advance via your seller portal and email. You may cancel your listing at any time before a new billing period begins.

4. Payout terms

Funds from a sale are held in escrow by Avarius until the order is confirmed as delivered (either by courier tracking confirmation or buyer confirmation). Once delivery is confirmed, funds are released to your nominated payout account, minus the applicable commission, on our standard payout cycle. This escrow model protects both buyers and brands by ensuring payment is only finalised once a customer has actually received their order.

5. Brand code of conduct

As a brand on Avarius, you agree to:

  • List accurate, honest product descriptions, pricing, and imagery
  • Keep stock levels and order status up to date in your seller portal
  • Dispatch orders within the timeframe stated on your listings
  • Package products safely and appropriately for their contents and courier handling
  • Communicate with customers respectfully and respond to order queries promptly
  • Comply with all applicable South African law relevant to your products, including food safety, labelling, and consumer protection requirements
  • Keep your pickup address and contact details current so Avarius can book courier collection through Bob Go on your behalf, or arrange your own courier (Courier Guy, Pargo, PostNet, or another provider) capable of providing proof of delivery

6. Grounds for suspension

Avarius may suspend or remove a brand's listings where we identify:

  • Repeated or serious failure to fulfil orders within a reasonable time
  • Misrepresentation of products, pricing, or brand identity
  • A pattern of customer complaints that goes unresolved
  • Sale of counterfeit, unsafe, or prohibited goods
  • Attempts to circumvent Avarius fees by directing buyers off-platform
  • Breach of this agreement, our Terms of Service, or applicable law

Where possible, we will notify you and provide an opportunity to resolve the issue before suspension. Serious or repeated breaches may result in immediate suspension.

7. Ending this agreement

You may close your brand account at any time by contacting hello@avarius.store. Outstanding orders must be fulfilled and any pending payouts will be settled according to our standard payout cycle.
